Terms of Service

These Terms of Service govern your use of GrowthAmp's platform and services. By accessing or using GrowthAmp, you agree to be bound by these terms.

1. Service Description

GrowthAmp provides an autonomous AI growth agent for performance marketing, including attribution auditing, capital allocation recommendations, campaign intelligence, and related analytics services. The platform is designed for business use by marketing teams at mobile app companies.

2. Eligibility and Account

You must be at least 18 years old and authorised to act on behalf of your organisation to use GrowthAmp. You are responsible for maintaining the security of your login credentials and for all activity under your account.

3. Client Data and Authorisation

By connecting third-party platforms (Appsflyer, Google Ads, Meta) to GrowthAmp, you represent that you have the right and authority to grant GrowthAmp access to that data. You are responsible for ensuring your use of GrowthAmp complies with your agreements with those platforms.

GrowthAmp will access and process your marketing data solely to provide the services described. We will not use your data for purposes beyond service delivery as described in our Privacy Policy.

4. AI Recommendations and Autonomous Actions

GrowthAmp's recommendations are generated by AI systems and are provided for informational purposes. While we design our systems with significant care, AI recommendations may contain errors.

Autonomous campaign actions (budget changes, bid adjustments, partner pauses) are executed only upon your explicit approval. You remain responsible for all marketing decisions and their outcomes. GrowthAmp is not liable for campaign performance outcomes resulting from approved recommendations.

5. Acceptable Use

You agree not to:

• Use GrowthAmp to violate any applicable laws or third-party platform terms of service
• Attempt to reverse engineer, copy, or resell GrowthAmp's technology or methodologies
• Share your account credentials with unauthorised parties
• Use GrowthAmp to process data you do not have rights to access
• Attempt to circumvent our security measures or access other clients' data

6. Intellectual Property

GrowthAmp's platform, methodologies, IP frameworks, and technology are proprietary to GrowthAmp. Your data remains yours. Derived findings and reports generated from your data are provided to you for your use.

7. Confidentiality

Each party agrees to maintain the confidentiality of the other's confidential information. GrowthAmp will not disclose your marketing data, performance metrics, or business information to any third party except as required to provide the service or as required by law.

8. Service Availability

We aim to maintain high service availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for losses arising from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, GrowthAmp's liability for any claim arising from these terms or use of our services is limited to the fees paid by you in the three months preceding the claim. GrowthAmp is not liable for indirect, incidental, or consequential damages.

10. Termination

Either party may terminate the engagement with 30 days written notice. Upon termination, your access will be revoked and your data will be deleted from our systems within 90 days, except where retention is required by law.

11. Governing Law

These terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.

12. Changes to Terms

We may update these terms periodically. We will notify you of material changes via email. Continued use after changes constitutes acceptance of the updated terms.
